Terms of Service

These Terms of Service outline the obligations, rights, and responsibilities between Craft Orbitals (“the Agency”) and its clients (“the Client”). By engaging our services or accessing our website, you agree to be bound by these Terms.

1. Services Provided

Craft Orbitals specializes in the following services:

• Web and mobile app development.
• Branding and UX/UI design.
• Social media management.
• SEO optimization and digital marketing.
• Copywriting and content creation.
• CAC (Corporate Affairs Commission) registration.

Specific deliverables, timelines, and pricing for each service will be outlined in a separate agreement or project proposal.

2. Engagement and Payment Terms

• Quotes and Proposals: All project scopes and costs will be detailed in written proposals. Acceptance is required before the commencement of work.
• Payments: Clients are required to pay a deposit (typically 40%-60%) before work begins. The remaining balance is due upon project completion or as outlined in the proposal.
• Late Payments: Late payments are subject to a 10% monthly late fee or a pause in project development.
• No Refunds: Payments are non-refundable. Clients are encouraged to review project deliverables during the milestone approval process thoroughly.

3. Client Responsibilities

• Provide accurate and complete information for the project.
• Respond promptly to requests for feedback, approvals, or content.
• Ensure all materials provided (e.g., logos, content) comply with copyright and other legal requirements.

4. Revisions and Changes

• Clients are entitled to up to 3 rounds of revisions per milestone, as specified in the project agreement.
• Additional revisions will incur an extra fee.
• Changes to project scope after agreement will require a new proposal and additional fees.

5. Ownership and Intellectual Property

• Final deliverables become the property of the client upon receipt of full payment.
• Craft Orbitals retains the right to showcase completed projects in portfolios, case studies, or marketing materials unless otherwise agreed.
• Drafts, templates, and unused concepts remain the intellectual property of Craft Orbitals.

6. Confidentiality

Both parties agree to keep all non-public information confidential unless written consent is provided.

7. Refund Policy

• All payments are non-refundable once the project has commenced.
• Exceptions may be considered only if no significant work has been undertaken, at the discretion of Craft Orbitals.

8. Dispute Resolution

• In the event of a dispute, parties agree to resolve matters through mediation before pursuing legal action.

9. Termination

• Either party may terminate the agreement with written notice. The client is responsible for payment for all work completed up to the termination date.
• Additionally, Craft Orbitals reserves the right to take projects offline or discontinue services if the client fails to fulfill payment obligations, including project fees or retainer fees, as outlined in the agreement. Such actions will be communicated to the client in advance to provide an opportunity to resolve the payment issue.

10. Limitation of Liability

Craft Orbitals is not liable for:

• Indirect or consequential damages.
• Delays caused by third parties or client’s failure to provide required materials or feedback.
• Errors or omissions in deliverables after final approval by the client.

The Client is responsible for final proofreading and approval of all materials before they go live.
